In February 2021, CLARKE negotiated a substantial settlement in a contested probate estate matter. Probate estate administration can often involve the settlement of claims made on the estate. CLARKE represented a statutory heir who the personal representative administering the estate moved to disqualify from receiving a substantial distribution. CLARKE challenged the legal basis and alleged facts given to support disqualification, including a pre-hearing motion to limit the evidence the personal representative intended to introduce and a motion to disqualify the attorney representing the personal representative because he was a necessary witness to relevant facts. Negotiations ensued and the parties reached a settlement agreeable to the heir.
